What Your Business Must Know

The Automated External Defibrillators (Public Access) Act 2022 and Regulations 2024 create mandatory obligations for many SA buildings. Here's exactly what's required — explained by people who understand what happens when an AED isn't available.

📅 Compliance deadlines: Crown buildings: Required to comply from 1 January 2025 (passed) | Non-Crown buildings: Required to comply from 1 January 2026 — this deadline has now passed. If you are not yet compliant, act immediately.

SA legislation imposes significant financial penalties on building owners who fail to meet AED requirements. Non-compliance is not just a legal risk — it's a life-threatening risk your staff and visitors face every day.

Does the Law Apply to My Building?

The Act applies to "relevant buildings" — defined as publicly accessible buildings with a floor area of 600m² or more. The following 14 building categories are specified in the legislation:

Swimming pool facilities
Public libraries
Local government offices
Town halls
Schools & educational facilities
Retirement villages
Aged care facilities
Caravan parks
Casinos
Theatres & cinemas
Places of worship
Fitness & recreational facilities
Shopping centres
Other specified public buildings

Excluded from the legislation: Hospitals, carparks, and correctional facilities — these have separate regulatory frameworks covering defibrillation.

Other Requirements Under the Act

Beyond purchasing an AED, the legislation requires building owners to:

  • Register the AED on the SA Ambulance Service AED Register within 14 days of installation
  • Maintain compliant signage — both inside the building and at the entrance
  • Ensure the AED is readily accessible to members of the public during opening hours
  • Keep pads and batteries current and serviceable at all times
  • Ensure the device is maintained in accordance with manufacturer specifications
AED Signage: Take a look at the ARC (Australian Resuscitation Council) site here for a guide on AED signs. In particular, note AED signs are to be white image / text on green background, or green image / text on white background. Other colours, such as red, may cause confusion and cause a rescuer to pass on by believing there is a fire appliance at the location instead of an AED.

Does the SA AED law apply to my small business?

How often does an AED need to be serviced in SA?
The Act requires devices to be maintained in accordance with manufacturer specifications, which typically involves annual professional servicing and regular self-test monitoring. Pads and batteries have fixed expiry dates and must be replaced on schedule. Can any staff member use an AED, or do they need training?
Modern AEDs are designed to be used by untrained bystanders — they provide voice and visual prompts guiding every step. However, staff who have completed CPR/AED training respond faster and more effectively. While SA legislation doesn't mandate staff training, Defibshop strongly recommends it. Is there funding available for SA not-for-profit organisations?
Yes. SA Health administers a grant programme offering $1,000 toward AED purchase costs for eligible not-for-profit organisations. Funding rounds are periodically open — contact Defibshop and we'll advise on current availability and assist with the application process.
